Terms of Service

These Terms of Service ("Terms") govern your use of the Swift Support platform at swiftcare-app.com and our mobile apps (together, the "Platform"), operated by Swift Support ("we", "us", "our"). By creating an account or using the Platform you agree to these Terms. If you do not agree, please do not use the Platform.

1. What Swift Support is

Swift Support is a marketplace that connects customers with independent local service providers. We help you find each other, communicate, agree a quote, and arrange payment. We are not a party to the service agreement between a customer and a provider, and we do not perform the services ourselves. The contract for the work is directly between the customer and the provider.

4. The marketplace and how payment works

A customer posts a job, our AI matches suitable providers, providers send quotes, and the customer chooses one. Key points:

5. Provider verification — disclaimer

We carry out reasonable verification steps and operate a ratings system to help build trust. However, we do not employ providers and cannot guarantee the quality, safety, legality or outcome of any service. Verification and ratings are aids, not guarantees. Customers should use their own judgement, confirm relevant licences or insurance where needed, and deal with providers at their own discretion.

6. Ratings and reviews

Customers and providers can rate each other after a job. Ratings must be honest and based on genuine experience. We may remove ratings or content that are abusive, fake or in breach of these Terms.

7. Fees and refunds of the platform fee

The only amount Swift Support charges and holds is the platform commission. If an introduction fails — for example a provider no-show or a job that is not done — the platform fee may be refunded, including via our AI-assisted dispute review. Because the job amount is paid directly between customer and provider, any refund of the work itself is a matter between those two parties; Swift Support can assist but is not responsible for refunding amounts it never held.

If a customer and provider disagree about a job, we encourage you to resolve it through the in-app chat first. We offer a dispute process, including AI-assisted review, to help reach a fair outcome on the platform fee and to inform our trust and safety decisions. Our decision on the platform fee is final, but you remain free to pursue any rights you have against the other party directly.

9. Limitation of liability

To the maximum extent permitted by South African law, Swift Support is not liable for any loss or damage arising from the acts or omissions of a customer or provider, the quality or outcome of any service, or your use of the Platform, beyond the amount of the platform fees you paid us for the relevant transaction. Nothing in these Terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act where it applies.

10. Intellectual property

The Platform, its software, branding and content are owned by Swift Support or its licensors. You may not copy, modify or reuse them except as allowed by law or with our permission. You keep ownership of content you post, but grant us a licence to use it as needed to operate the Platform.

11. Changes to the Platform or Terms

We may update the Platform and these Terms from time to time. We will post the updated Terms here with a new effective date. Continued use after changes means you accept the updated Terms.

12. Termination

You can stop using the Platform and delete your account at any time (see Delete account & data). We may suspend or terminate accounts that breach these Terms or where required by law.

13. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute, subject to your rights under applicable consumer protection law.
